ARTICLE 1 - SUBJECT OF THE GENERAL CONDITIONS OF SALE

The purpose of these General Conditions of Sale is to define the contractual provisions between the FONDATION GIACOMETTI and the CUSTOMER as well as the conditions applicable to any TICKET order made on the web site https://giaco.shop.secutix.com (for individuals) or https://giaco-groupes.shop.secutix.com (for structures).

CUSTOMERS acknowledge having read these terms and conditions prior to the validation of their order. The validation of the order implies acceptance of the general conditions of sale without exception by the CUSTOMER.

The Fondation Giacometti reserves the right to adapt or modify at any time these terms and conditions of sale. In case of modification, the general conditions of sale in force on the day of the placing of the order will be applied.

ARTICLE 2 - CHARACTERISTICS OF TICKETS OFFERED FOR SALE

Access to the Institut Giacometti can only be gained by reservation by Internet on our web site: www.fondation-giacometti.fr, whether for a free visit, a guided tour, access to the library, the Prints and Drawings Room, an event (conference, symposium), as well as for any other purchase of a product proposed on our site.

The customer has the opportunity to buy:

One or more tickets giving entrance to the Institut (Tour of the Studio and the temporary exhibition).

One or more tickets for a guided tour.

One or more tickets for the Prints and Drawings Room

One or more products offered for sale online (exhibition catalogues, derived products, etc.)

Unless otherwise indicated, the total number of entrance TICKETS to the Institut accumulated per booking per person (excluding group reservations) may not be greater than: 6.

CUSTOMERS are informed, in real time, when placing their order, of the availability of the desired TICKETS.

ARTICLE 3: PRICE OF TICKETS

The prices of TICKETS are those mentioned on the website www.fondation-giacometti.fr at the time of the order. They are indicated in euros net of taxes.

The total price on validation of the order is the final price, all taxes and management fees included. It is included in the order confirmation email and the order summary.

The FONDATION GIACOMETTI-INSTITUT reserves the right to change prices. TICKETS will be invoiced on the basis of the tariffs in force at the time of the registration of orders.

The site proposes several rates depending on the type of visit and the age or status of the beneficiary of the right of entrance. Visitors who may benefit from a reduced rate or enter free of charge (see the list in the Practical Information tab of the www.fondation-giacometti.fr web site) must present an identity document and relevant supporting documents at the control desk.

ARTICLE 4: ORDER AND VALIDATION

The procedure for purchasing an online ticket is found on the web site: https://giaco.shop.secutix.com for individuals, and on the web site: https://giaco-groupes.shop.secutix.com for groups.

The different types of tickets are presented on the Home page. A CUSTOMER account must be created in order to make the purchase.

ARTICLE 5: PAYMENT

5.1 Payment terms

As reservation of tickets can only be made online, payment of the TICKETS by the CUSTOMER is carried out in one of the following ways, at the choice of the CUSTOMER:

By bank card: Mastercard, Visa.

by PayPal

As soon as the transaction is completed, an order summary is sent by email to the CUSTOMER. CUSTOMERS can then obtain their ticket(s) by logging into their Customer account.

5.2 Securing payments

The FONDATION GIACOMETTI uses the services of the Ingenico company for any payment made on the site: https://giaco.shop.secutix.com (or https://giaco-groupes.shop.secutix.com). The site has an online “3D Secure” payment system to encrypt the CUSTOMER’s bank card number.

ARTICLE 6: ORDER CONFIRMATION           

Your TICKET order is only definitively confirmed, and only engages the FONDATION GIACOMETTI, on reception of the email confirming that the order has been validated.

The confirmation email acknowledges receipt of the order and contains the link to the customer’s personal space in order to download the ticket.

ARTICLE 7: OBTAINING TICKETS

Tickets will be delivered to the customer's personal space. They must be downloaded on to a mobile phone or printed on A4 white paper; barcodes and mentions must be perfectly legible.

ARTICLE 8: TERMS OF USE OF THE TICKETS

8.1 All TICKETS are systematically checked at the entrance to the site. This check consists of a scan of the barcode written on the TICKET (or QR Code). The TICKET is personal and untransferable. The TICKET must be kept until the end of the visit.

8.2 Only TICKETS printed on white A4 paper or presented on a smartphone with a QR Code and perfectly legible mentions will be accepted.

Partially printed, stained, damaged or illegible TICKETS will not be accepted.

8.3 The FONDATION GIACOMETTI reserves the right to verify the identity of person(s) benefiting from a reduced rate or entry free of charge. Acceptable for this purpose: national identity card, passport, driving licence.

8.4 Any free or reduced rate TICKET must be presented with proof of the free or reduced rate. Only the following valid documents are accepted to justify free or reduced rate admission:

- for age-related discounts or free admissions: valid national identity card or passport and family record book for children.

- for students: valid student card

- for people with disabilities:

- for jobseekers: Pôle Emploi certificate less than six months old,

- for RSA beneficiaries: CAF certificate less than three months old.

- for beneficiaries of the minimum old-age pension: annual certificate of receipt of the supplementary disability allowance (ASI) or the solidarity allowance for the elderly (ASPA).

- for ICOM members: a valid membership card.

8.5 TICKETS are only valid for the visit and time specified at the time they are ordered. CUSTOMERS must arrive at the time specified on their tickets. Beyond 30 minutes late, the FONDATION GIACOMETTI-INSTITUT reserves the right to refuse access to the visit or event concerned.

In the event of a breach of any of the conditions set out in this article 8, the FONDATION GIACOMETTI-INSTITUT reserves the right to refuse access to the visit or event concerned.

ARTICLE 9: FRAUDULENT USE

It is strictly forbidden to duplicate or forge a TICKET in any way.

Anyone who illegally reproduces a TICKET and/or uses a counterfeit TICKET shall be liable to criminal prosecution.

The FONDATION GIACOMETTI will refuse access to the site to any bearer of a TICKET with a barcode that has already been scanned.

It is strictly forbidden to sell the TICKET at a price higher than the price indicated on the TICKET.

ARTICLE 10: LOSS AND THEFT OF TICKETS

The FONDATION GIACOMETTI declines any responsibility in the event of loss or theft of TICKET(S), including within the precincts of the site concerned.

ARTICLE 11: CANCELLATION, REFUNDS, EXCHANGES

11.1 In accordance with Article L 121-21-8 12° of the French Consumer Code, the purchase of a TICKET is not subject to any right of withdrawal.

No TICKET may be exchanged or refunded once it has been issued, except in the case of cancellation by the Fondation Giacometti of the visit or event to which the TICKET gives the right of admission under the conditions defined in Article 11.2.

The exchange or refund is, however, excluded when cancellation is due to a case of force majeure as defined in Article 13.

11.2 In case of cancellation by the FONDATION GIACOMETTI-INSTITUT of the visit or event appearing on the TICKET, the CUSTOMER will be informed as soon as possible and if possible, a postponement of the visit or event concerned will be proposed. If postponement is impossible, the CLIENT can be refunded. The request for refund must be made within three months from the date of cancellation or modification on presentation of the non-invalidated ticket and bank details (bank account statement or credit card number with expiry date), to the exclusion of any other compensation or indemnity by email or mail.

ARTICLE 12: RESPONSIBILITY

12.1. The FONDATION GIACOMETTI cannot under any circumstances be held liable for any non-performance or poor performance of the services to which the TICKETS give entitlement which is attributable either to the CUSTOMER, to the unpredictable and insurmountable fact of a third party, or to a case of force majeure as defined in Article 13 of these General Conditions of Sale.

12.2 Except for any dysfunction of the site http://www.fondation-giacometti.fr/ attributable to the Fondation, the FONDATION GIACOMETTI-INSTITUT cannot be held responsible for anomalies that may occur during ordering, treatment, downloading or printing of the TICKET, attributable either to the CUSTOMER, or to the unpredictable and insurmountable fact of any third party foreign to the service, or to a case of force majeure as defined in Article 13 of these General Conditions of Sale.

ARTICLE 13: FORCE MAJEURE

The CUSTOMER and the FONDATION GIACOMETTI-INSTITUT cannot be held responsible for any non-compliance resulting from a case of force majeure. The case-law of French courts and tribunals considers in particular the following to constitute cases of force majeure: total or partial strikes whether internal or external to the FONDATION GIACOMETTI-INSTITUT, blockage of means of transport or supply for whatever reason, government or legal restrictions, computer failures, and the blocking of telecommunications including networks and especially the Internet.

ARTICLE 14: PERSONAL DATA

When placing the order, personal data are requested from the CUSTOMER.

The personal information requested from the Customer is required to process orders and to print rights of entrance and invoices.

The personal data collected are processed by the FONDATION GIACOMETTI in accordance with the legal provisions relating to the protection of personal data specified in the French law No. 78-17 of January 6, 1978 relating to Data Processing and Freedom of Information.

- the Customer is informed that this authorised treatment of information has been declared to the CNIL, the French body responsible for data privacy.

- Customers have at any time a right to access, modify, rectify and delete personal data concerning themselves. They may exercise this right with the FONDATION GIACOMETTI by sending a letter including proof of identity (photocopy of an identity document) to the following address:
